§ 86-7. Maintenance of railroad crossings.

  • Operators of a line of railroad through or within the corporate limits of the city shall keep their crossings in repair and safe condition at the intersection of any street and shall open any ditch along their right-of-way whenever so ordered to do by the city council through its proper officers. Any person refusing or neglecting so to keep in repair and safe condition for travel such crossings and bridges where they intersect any street or sidewalk in the city, or which shall fail or refuse to build crossings over their railroad when ordered so to do by the city council, shall incur the liability of having such work done and performed at the expense of the city; and the expense thereof so paid by the city shall be and create a lien upon the property of such railroad and its rolling stock, which lien shall be foreclosed as prescribed by the laws of the state.
