§ 90-54. Approval.

  • (a)

    At a scheduled public meeting, the board will receive comments on and review the preliminary plat to determine its conformance to this chapter. While no public hearing shall be required on the proposed plat unless a street or public place is intended to be vacated, the subdivider and any other person interested in or affected by the proposed subdivision shall have a right to be heard by the board either in person or by letter, before the action of the board is taken. The board shall have the right to call for a public hearing if it deems a hearing advisable.

    (b)

    The board may approve the preliminary plat as presented or with minor modifications, if found to be in conformance with this chapter, or may disapprove the plat when not found to be in conformance or readily capable of being revised to conform. Approval of the preliminary plat, subject to conditions, revisions and modifications as stipulated by the board, shall constitute conditional board approval of the subdivision as to the character and intensity of development and the general layout and approximate dimensions of streets, lots and other proposed features.
