§ 86-11. Duty of abutting property owners to construct and repair sidewalks.

  • The city council shall require the owner of any lot, parcel or tract of land abutting on any street or avenue in the city to construct and keep in repair along and adjacent to the lot, parcel or tract of land sidewalks of such kind and width and of such material as the city council may deem proper. If the owner shall refuse or neglect to construct or repair the sidewalk as he shall be required by ordinance or resolution of the council, the city may let, construct or repair the sidewalk, and the costs thereof shall be a lien superior to all other liens, except only liens for taxes, upon such lot, parcel or tract of land along and in front of which the paving has been constructed or repaired, and such lien may be enforced by suit at law or in equity in any court having jurisdiction of the amount of such claim.
